Expired Residence Permit and a silent Prefecture is this a crisis or just another monday ?

Sara, a full-time employee in France for several years. Her residence permit is set to expire and she submits her renewal application online on time.But....weeks go by...then months... her permit expired and still no answer from the prefecture.
Let’s take a moment to assess the situation before we all start freaking out with her !

Sara panics. Can she still work? Is she suddenly undocumented? Could she face issues with her employer, a random check, or even an order to leave France?
Good news: French law provides a continuity of rights mechanism — often overlooked, but very important to know.

So what does this mean ?

Let’s go back to Sara.Because she submitted her renewal application on time, she benefits from a real legal safety cushion. For up to 3 months after the expiration of her permit, she can:● remain legally in France,● continue working lawfully,● keep her social rights,● even without a receipt and even without any response from the prefecture.
Sooo, just like Sara, you can keep living your life normally, going to work, paying rent, showing up at the office : without panicking at every corner.
Of course, this protection only applies if the renewal application was submitted before the permit expired ( late applicants… we see you)
